§1
Validity with Respect to Contractors and Definition of Terms
(1) The following Terms and Conditions of Business are valid for all deliveries between us and a consumer in the version valid at the time of the order.
A consumer is any natural person who completes a transaction for purposes that predominantly can be assigned neither to their commercial nor to their independently professional activities.
§2 Realisation of a Contract, Storage of the Contract Text
(1) The
following provisions regarding the conclusion of a contract apply to
orders via our internet shop https://www.phoibos.at

(3) The presentation of goods in our internet shop represents no legally binding contractual offer from our side, but instead is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits an offer that is binding when a purchase agreement is completed.
(4) When an order is made in our internet shop, the following regulations apply: the consumer submits a binding contractual offer, in that he/she successfully completes the ordering procedure provided in our internet shop.
The order occurs in the following
steps:
a) Selection of the desired goods
b) Verification of the information
entered in the shopping cart
c) Declaration of the shipping
address
e) Renewed verification and/or correction of the respective data provided
f) Binding dispatch of the order by clicking the button “order with duty to pay”
Before dispatching the binding order,
by clicking on the “Back”-button displayed in the input screen
after controlling his/her entries, the customer can return
incrementally to the previous screen(s) and correct any mistakes in
the information entered, or can terminate the order by closing the
internet browser. We confirm the receipt of the order immediately
with an automatically generated E-Mail (“Order Confirmation”).
With this step we accept your offer.
(5) Storage of the contract
text with orders via our internet shop: we send you the ordering
information and our General Terms and Conditions via E-Mail. You may
review our General Terms and Conditions at any time at https://phoibos.at/en/Shopservice/General-Terms-and-Conditions-of-Business/ You
may review your ordering information and the status of your order at
any time in your customer account.
§3 Prices, Shipping Costs, Payment, Payment Due Date
(1) The prices indicated include the
statutory sales tax and other price components. The shipping costs
are indicated during the course of the order at the second
verification of the order (above, point e); in addition, during this
step the sales tax is indicated.
(3) If the customer has opted
to pay using prepayment, he/she receives a pro forma invoice from us
after receipt of the order, and pledges to pay the purchase price
upon receipt of the pro forma invoice. Shipping occurs after payment
is received.
(1) Unless we have specifically indicated otherwise in the product description, all articles offered by us are immediately ready for dispatch. In the case of any delivery delays, the customer will be informed as soon as possible. Shipping occurs within three business days, whereby the period of time for the delivery, in the case of prepaid items, begins on the day after the payment order to the bank commissioned to transfer the funds, and with all other payment options, on the day after the completion of the contract. If the final delivery date falls on a Saturday, Sunday, or other legal holiday at the delivery address, the deadline for delivery falls on the next business day.
(2) Using our best judgement, we choose the transporter, but we cannot guarantee the choice of the fastest and cheapest shipment.
(3) The actual delivery time cannot be guaranteed due to possible circumstances beyond our control, for example issues related to higher authorities, unforeseen operational disruptions, administrative procedures, delays in transport and customs clearance, work-related conflicts etc.
(4) E-Books are generally protected
by copyright. In so far as you purchase E-Books, we do not convey to
you in this regard proprietorship, but a non-exclusive and
non-transferable right of use (“usufructuary permission”). This
right of use only entitles you as a customer to download the E-Book
and to save it for your own private use.
(5) The risk of
accidental ruin and accidental deterioration of the purchased object,
also with sale by dispatch, also passes over to the purchaser first
when the object is handed over to the purchaser.
§5 Reservation of ownership
We reserve the right of ownership of the wares until the purchase price has been fully paid.

by means of an unambiguous declaration (e.g. by letter sent via post, or E-Mail) of your decision to cancel this contract. For this, you may use the attached cancellation form, but this however is not mandatory.
Consequences of
Cancellation
If you cancel this contract, we
must refund to you all payments that we have received from you,
including the shipping costs (with the exception of any additional
costs that might have arisen if you chose another method of shipping
other than the most economical standard delivery provided by us),
promptly and at the latest within fourteen days after the day on
which we received the notification of your cancellation of this
contract. For this refund, we use the same method of payment that you
applied at the original transaction, unless something else has been
expressly agreed upon with you; in no case will any charges accrue to
you due to this refund of payment.
We can withhold the refund of payment until we have received the wares again or until you have provided verification that you have returned the wares, whichever of these occurs earliest.
You must send back or deliver the wares promptly, and in any event at the latest within fourteen days after the day on which you informed us about the cancellation of the contract. The deadline is protected, when you dispatch the wares before the deadline of fourteen days.
You are responsible for the immediate costs of the return of the wares.

§8 Guarantee
Legal guarantee regulations are in effect.
§9 Liability
We are responsible for damage according to legal regulations. Responsibility for damage caused by slight negligence is, however, ruled out.
§10 Contract Language
German is exclusively available as the contract language.
