1. Legal Basis

1.1. The EU General Data Protection Regulation, the Data Protection Law 2000, as well as the Data Protection Amendment Act 2018 serve to ensure the rights for protection of personal data. We handle your data exclusively in conformity with the legal provisions (DSGVO, DSG 2018, TKG 2003).

2. Basics

2.1. The person responsible is Mag. Roman Jacobek (jac@phoibos.at).

2.2. It is a particular concern of ours that all personal data that you entrust to us is protected and securely stored. In this document you can learn more about how we utilize and process your personal data.

3. Allocation, legal basis, storage period, and data receiver

3.1. We require the collected personal data in order to deliver the articles ordered by you, and to charge you for them. For this purpose, the data are compiled, saved, processed, and utilized.

3.2. The legal foundations for the processing of your personal data are, on the one hand, the completion of the contract (online purchase), interests, the fulfilment of our legal and contractual obligations as well as, on the other hand, your consent (dispatch of the order, contract form, newsletter, cookies). The non-provision of data can have a variety of consequences.

3.3. We process your personal data (name, address, contact data, credit card data), insofar as necessary, for the duration of the entire business relationship (from initiation, processing, up to the delivery of the article) as well as, furthermore, in accordance with the legal obligations for storage and documentation that arise from, amongst others, the Austrian Commercial Code (UGB), the Federal Tax Code (BAO), as well as up until the conclusion of any possible litigation, on-going warranty and guarantee periods.

3.4. In order to ship your wares, it is necessary to provide a postal service provider with your address details. An order processing agreement compliant with Art 28 DSGVO is finalized. You may request additional information regarding the order processor commissioned at jac@phoibos.at.

4. Contact Form

4.1. Your information including personal data from our contact form, for the processing of your request, is conveyed to us by our provider, further managed, and stored in our system. These data will not be compiled or shared without your declaration of consent. Without these data, we cannot process your requests and inquiries.

4.2. The processing of data is carried out on the basis of the legal provisions of § 96 Abs 3 TKG as well as those of Art 6 Abs 1 lit a (consent) DSGVO.

5. Newsletter

5.1. On the website you can subscribe to our newsletter; this takes place via a Double-Opt-In procedure. After registering, you will receive an E-Mail in which you are requested to confirm your registration. Without providing this data, the transmission of the newsletter is not possible. You can unsubscribe from the newsletter by clicking the ‘unsubscribe’ link at the end of each newsletter.

5.2. The transmission of the newsletter takes place directly over our mailserver; the data are not shared with third parties.

5.3. The processing of data is carried out on the basis of the legal provisions of § 96 Abs 3 TKG as well as those of Art 6 Abs 1 lit a (consent) DSGVO.

6. Online Purchases

6.1. We point out that, for the purpose of a simpler purchasing procedure and for the subsequent processing of contracts in the webshop (operator: all-inkl.com – Neue Medien Münnich) the name, address and credit card number (only if payment is desired by means of credit card) of the purchaser are recorded. The data that you make available are necessary for the completion of the contract and/or for the carrying out of pre-contractual measures. Without these data, we are unable to complete the contract with you.

6.2. A forwarding of the data to the credit card companies takes place for the purpose of debiting the purchase price, and to the transport/shipping companies commissioned by us for the purpose of delivering the goods, as well as to our tax accountant for the purpose of fulfilling our obligations according to tax law. These have pledged themselves to uphold the applicable provisions in terms of data-protection law. An order processing agreement according to Art 28 DSGVO has been finalized. You may request additional information regarding the order processor commissioned at jac@phoibos.at.

6.3. The data processing is carried out on the basis of the legal provisions of § 96 Abs 3 TKG as well as of Art 6 DSGVO (in particular, consent and/or necessity for fulfilment of contract).

6.4. Your ordering data are deleted from the online shop after 6 months; the address details remain saved for future orders. In case you wish an earlier deletion of your ordering data or a deletion of the address details, please send a message to order@phoibos.at.

7. Cookies

7.1. Cookies can be deployed on our internet platform in various ways. Cookies are small pieces of text information that enable a recognition of the user and an analysis of his/her usage of our website. The information generated is transmitted to the server of the provider and saved there. This information serves in general to make our internet presence more user-friendly, more effective and more secure. In addition, cookies serve to measure the frequency of page views and for general navigation.

7.2. By using our website, you thereby agree that we apply cookies. In your browser settings, you can decline the application of cookies. To see how this functions more specifically, please refer to the instructions of your browser provider. If you decide against specific technical and/or functional cookies, the functionality of our website may potentially be restricted. A number of cookies remain stored on your terminal device until you delete them.

7.3. Your IP-Address will not be stored.

7.5. The data processing is carried out on the basis of the legal provisions of § 96 Abs 3 TKG as well as of Art 6 DSGVO (in particular, consent).

8. Consent and Right of Revocation

8.1. If your consent is necessary for the processing of your data, we will process it only after your express consent has been given.

8.2. Fundamentally, we process no data of underage persons and we are also not authorised to do so. By providing your consent, you confirm that you have completed the fourteenth year of life or that the consent of your legal representative has been obtained.

8.3. You can revoke your consent at any time by writing to the following E-Mail: jac@phoibos.at. In such a case, the data that have been saved until then will be made anonymous and subsequently only used for statistical purposes without personal specifics. By revoking your consent, the legality of the processing carried out due to the consent up until revocation will not be affected.

9. Data Security

9.1. Phoibos Verlag deploys technical and organisational security measures to protect the saved personal data against accidental or deliberate manipulation, loss, or destruction and against being accessed by unauthorised individuals. Our security measures are continually being improved in accordance with technical advances.

10. Your Rights

10.1. You have the right at all times for information, via the responsible individual Mag. Roman Jacobek, regarding your personal data. As long as no legal obligation to preserve records exists, you have the right for this data to be deleted, as well as to object to its processing. Furthermore, you have the right to correct or amend the data, as well as to limit its processing, and the right of data portability as well as to lodge a complaint with the Austrian data protection authorities (Wickenburggasse 8-10, 1080 Wien, E-Mail: dsb@dsb.gv.at).
